1. Introduction

Welcome to Testive! These Terms and Conditions outline the rules and regulations for the use of Testive’s academic and SAT/ACT tutoring services. By accessing and using our services, you agree to comply with these terms.

2. Academic Tutoring Services

2.1 Personalized Tutoring Approach

Testive’s Academic Tutoring programs are customized to each student’s individual needs, helping them improve skills, understand course material, and gain confidence. Sessions are subject-specific and goal-oriented.

2.2 Structure of Services

  • Initial Assessment: Tutors review the student’s academic background to create a personalized plan.
  • Customized Support: Sessions address coursework, foundational skills, and academic improvement strategies.
  • Progress Tracking: Tutors document session notes detailing completed work and next steps.

2.3 Turnaround Time for Assignments or Feedback

  • Standard Turnaround: Assignments or feedback are reviewed within 48 hours.
  • Rush Requests: For expedited work (24 hours or less), a $200 rush fee applies.

2.4 Response Time for Emails or Outreach

Tutors respond to emails or other outreach within 24 hours during regular business hours.

2.5 Cancellation Policy

  • Grace Period: Testive aims to accommodate changes when possible.
  • Late Cancellations (within 48 hours): Charged at full the hourly rate-medical exceptions allowed.
  • No-Shows: Charged at the full hourly rate.

2.6 Student Preparation

Before the first session, students must complete the Student Enrollment Form to provide relevant academic background information, areas of difficulty, and goals.

2.7 Additional Tutoring Hours

Additional hours can be purchased as needed. Students should discuss with their tutor to determine the best option.

3. SAT/ACT Tutoring Services

3.1 Personalized Test Prep Approach

Testive’s SAT/ACT tutoring programs are designed to maximize student test scores through strategic and individualized instruction.

3.2 Structure of Services

  • Baseline Exam: Students take a full-length adaptive practice test to assess strengths and weaknesses.
  • Customized Plan: Tutors develop a study plan based on baseline scores and student goals.
  • Focused Sessions: Sessions include test-taking strategies, practice questions, and targeted content review.
  • Progress Reports: Regular updates track student progress and highlight areas requiring additional focus.

3.3 Support Outside of Sessions

  • Online Platform Access: Students can access practice tests, drills, and score reports.
  • Detailed Feedback: Tutors provide comments and notes on completed practice work.

3.4 Turnaround Time for Practice Test Reviews and Score Updates

  • Standard Turnaround: Practice test reviews and score updates are completed within 48 hours.
  • Rush Requests: Expedited reviews (within 24 hours or less) incur a $200 rush fee.

3.5 Response Time for Emails or Outreach

Tutors respond to emails and outreach within 24 hours during regular business hours.

3.6 Cancellation Policy

  • Late Cancellations (within 48 hours): Charged at the full hourly rate.
  • No-Shows: Charged at the full hourly rate.

3.7 Student Preparation Before the first session, students must:

  • Complete the Student Enrollment Form.
  • Activate their online SAT/ACT account within 24 hours of receiving the link.
  • Complete the assigned baseline exam.

3.8 Additional Tutoring Hours

If additional tutoring hours are needed beyond the purchased package, students can discuss options with their tutor.

4. General Terms

  • Payment Policy: Fees for tutoring services must be paid in advance unless otherwise agreed.
  • Refund Policy: All sales are final. Refunds may be granted only in exceptional circumstances at Testive’s discretion.
  • Code of Conduct: Students are expected to engage respectfully with tutors and adhere to academic integrity.
  • Limitation of Liability: Testive is not responsible for a student’s academic performance or standardized test outcomes.

To ensure fairness to all students, instructors, and staff, please contact us at hello@hamptontutors.com at least 48 hours before your scheduled session for any time changes or cancellations to avoid a late cancellation fee.

5. Use of the Website

5.1 Permitted Use

You may use this website for lawful purposes only. You must not use this website in any way that causes, or is likely to cause damage to the website or impairment of the availability or accessibility of the website.

5.2 Prohibited Use

You must not use this website to copy, store, host, transmit, send, use, publish, or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit, or other malicious computer software. You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction, and data harvesting) on or in relation to this website without Testive’s express written consent.

5.3 Intellectual Property

The content on this website, including but not limited to text, graphics, logos, images, and software, is the property of Testive or its licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from any content on this website without the express written consent of Testive.

5.4 Limitation of Liability

Testive will not be liable for any damages arising from your use of this website, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

6. Privacy Policy

6.1 What we collect and why we collect it

Your privacy is very important to us. Accordingly, we have developed this statement concerning our privacy practices in order for you to understand how we access, collect, use, store, process, disclose,share, and delete the personal information that you provide to us from time to time in connection with your use of the Service.

In connection with your use of Testive (the “Service”), we may ask you to provide us with your personal information. We will collect your personal information by lawful and fair means. We will not collect your personal information without your knowledge or consent. In the case of students, the personal information we collect is limited to name and email address. We may ask parents, tutors, teachers, and school administrators for additional information to help us fulfill an order, including billing address, phone number, and payment information. Your payment information will be securely processed by Stripe.

We will use the personal information that you provide to us or that we otherwise access to offer the Service to you. For parents, teachers, tutors, and school administrators, this may include occasional email communications concerning the Service, your activities on our website, your transactions with us, and communications with us that you initiate.

We may also communicate with parents, teachers, tutors, and school administrators (but not students) about improvements we have made, or are planning to make, to the Service; premium features of the Service that we may make available to you from time to time; and related products and services that we offer, now or in the future.

We may use information concerning usage of our Service in an anonymized and aggregated format for purposes of conducting research and improving the Service for you and other users. If we are seeking to collect personal information for a purpose that is not related to or otherwise compatible with the purposes described above, before or at the time of collecting your personal information, we will identify for you the purposes for which your personal information is being collected before doing so. Additional purposes may appear in an update to this statement, which you will be prompted to review and to which you will be asked to consent before we use personal information in that manner. Personal information supplied to us by you should be relevant to the purpose, or purposes, for which it is to be used by us, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.

We will protect your personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification.

6.2 Cookies

We use third-party analytics programs, such as Google Analytics and Hotjar, to assess site performance and trends, and these programs may leave cookies on your browser.

We may also set up cookies on your browser when you log into the Service in order to keep you logged in as you navigate the Service.

If you are an affiliate who receives commissions by placing Testive links on your website, we store a cookie with your affiliate ID and map it to the user accessing our site through your link.

If you are a visitor accessing our site via an affiliate link, we store your IP address. If you place an order after visiting an affiliate link, your order details are stored along with your IP address.

6.3 Embedded content from other websites

Articles and pages on our site may include embedded content (e.g. videos, images, forms, etc.).

Embedded content from other websites behave in the same way as if the visitor has visited the other website. 6.4 How long we retain your data

For users who register on our website, including purchasers and free-trial users, we store the personal information they provide at account creation. This information is retained indefinitely. All users can see, edit, or request deletion of their personal information at any time. Users can also see and edit profile information, as can Testive personnel administering the Service.

We understand that you may have preferences for how your personal information is used. You may opt-out of email communications that you receive by clicking on any opt-out link provided within the emails. You can also send an email to us at info@testive.com, if you wish to communicate your preferences, including requesting access to, the ability to edit, or the deletion of your personal information, as described in the previous paragraph. Please understand that if you opt out of receiving certain communications from us or others, as long as you are a user of the Service, we may still use your personal information to communicate with you about the Service, including, for example, your future activities on our website, your future transactions with us, and communications with us that you initiate in the future. Please understand that, if you are no longer a user of the Services and you request that we delete any personal information we hold about you, the information we delete will not include any data we are obliged to keep for administrative, legal, or security purposes.

6.6 Compliance with privacy laws protecting children

Our website and the Service is generally intended for people who are at least 13 years old, even though it offers features, such as test practice materials, that can be used by children under 13 years of age. In any event, we strive to comply with the requirements of the Children’s Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under the age of 13 years, except for names provided by a consenting adult and only as strictly necessary for us to provide the Service to children based on the consent of parents, legal guardians, and other consenting adults, such as the children’s teachers, tutors, and school administrators, who have registered to use the Service. If you are under the age of 13 years, please do not access our website or the Service without permission from your parent, legal guardian, or other consenting adult, such as your teacher, tutor, or school administrator, and

do not register for an account of your own. If you are under 13 years of age, and you are using the Service, access the Service using an account that your parent, legal guardian, or other consenting adult has given you permission to use. If you are a child under the age of 13 years or an adult or other person 13 years or older, and, despite our efforts described in this paragraph, you believe that we have access or used personal information provided by or pertaining to a child under the age of 13 years without the consent of the child’s parent or legal guardian, please contact us using one of the methods described in the previous paragraph and we will delete the account.

6.7  Mobile and Messaging Consent

By messaging a Testive representative or asking to be so contacted, you grant permission for Testive to respond in kind.

No mobile or messaging consent information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7. Changes to Terms and Conditions

Testive reserves the right to modify these Terms and Conditions at any time. Your continued use of this website after any changes constitutes your acceptance of the new Terms and Conditions.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

9. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
